Licensing for Cloud for Industry Technologies. Microsoft Cloud for Industry products, services and solutions (collectively, “Cloud for Industry Technologies”) are licensed under the terms and conditions of the licensing agreement that you obtained for the Online Services from Microsoft, which incorporate the Product Terms site (https://go.microsoft.com/fwlink/?linkid=2173816) (the “Product Terms”) and the Microsoft Products & Services Data Protection Addendum (https://go.microsoft.com/fwlink/?linkid=2153219) (“DPA”), unless otherwise specified. The Product Terms and DPA detail the availability, use terms, and privacy/security commitments for the Cloud for Industry Technologies, including the “Other Online Services” section where you will find product-specific terms for Cloud for Industry Technologies that have been made generally commercially available by Microsoft.
Licensing Agreement. For customers who purchase or renew their applicable Microsoft Online Service subscription (including free trials) online from Microsoft, your licensing agreement is either the Microsoft Customer Agreement (https://go.microsoft.com/fwlink/?linkid=2214746) (“MCA”), or the Microsoft Online Subscription Agreement (https://go.microsoft.com/fwlink/?linkid=2131104) (“MOSA”) if the MCA is not available in your geography. For customers who purchase through another Commercial Licensing Program, such as an Enterprise Agreement, your licensing agreement is the agreement under which you purchased the services. You can obtain a copy of your commercial licensing agreement by contacting your Microsoft account representative or Microsoft Commercial Licensing.
Preview Terms. Your access to and use of any Cloud for Industry Technologies (or features thereof) which are marked “PREVIEW” or otherwise designated as being a preview version are subject to terms applicable to “Previews” as detailed in the Universal License Terms for Online Services section of the Product Terms and the DPA. The applicable Online Service subscription will be billed for fees and applicable taxes associated with use of Online Services and resources deployed by the Preview (if any) until your use is discontinued.
Certain Previews are subject to additional terms set forth below, if any. These Previews are made available to you pursuant to these additional terms, which supplement your agreement governing use of Online Services.
Production Ready PreviewsPreviews designated as production ready do employ privacy and security measures typically present in generally available Online Services. You may use production ready Previews to process Personal Data or other data that is subject to legal or regulatory compliance requirements. The following terms in the DPA apply to production ready Previews: Processing of Personal Data; GDPR and Data Security. If production ready Previews are made available within a Core Online Service (as defined in the Product Terms), the HIPAA Business Associate terms in the DPA also apply (unless otherwise specified).
Private PreviewsAny Cloud for Industry Technologies which are marked “Private PREVIEW” (including any related materials) are confidential information and subject to your Non-Disclosure Agreement with Microsoft.
Microsoft Generative AI Service PreviewsPreviews of generative AI features, including Copilots, within Cloud for Industry Technologies (“IGAI Previews”) are subject to the Microsoft Generative AI Services section of the Universal License Terms for Online Services in the Product Terms (https://go.microsoft.com/fwlink/?linkid=2182773).
No production use:
IGAI Previews are not intended to be used in production or in live operating environment unless explicitly designated as a production ready preview in product documentation.
Product documentation requirements:
Microsoft provides product documentation regarding appropriate use of the IGAI Previews, which is made available online by Microsoft and updated from time to time. You acknowledge and agree that you have reviewed the product documentation for IGAI Previews and will use the IGAI Previews in accordance with such documentation, including all relevant requirements in the Code of Conduct.
Data access and use:
As part of providing the IGAI Previews, Microsoft will process and store Customer Data submitted to the service, as well as Output Content, for purposes of monitoring for and preventing abusive or harmful uses or outputs of the service. Authorized Microsoft employees may review data that has triggered our automated systems to investigate and verify potential abuse unless product documentation for a given IGAI Preview explicitly states that such review is not performed.
Bing Search terms:
For any component of IGAI Previews that is powered by Bing, as disclosed in the product documentation, Customer’s use of Bing is governed by the Microsoft Services Agreement (https://go.microsoft.com/fwlink/?linkid=2178408) and the Microsoft Privacy Statement (https://go.microsoft.com/fwlink/?LinkId=521839), except that noncommercial use limitations do not apply to Products available for a fee through Microsoft volume licensing. The Data Protection Addendum does not apply to Customer’s use of Bing within IGAI Previews.
